摘要(Abstract)：
善治的提出是社会治理理念的重要转折,其要素具有多重性和争议性,但是其基础要素包含了合法性、参与、回应和公正,善治的实现也就是其要素的现实化过程。在社会秩序治理规则系统的视角中,良好的法律和善良习俗构成善治实现的两翼,缺一不可。在一国内部各区域之间经济、社会等因素发展不平衡的情况下,区域善治是国家善治实现的基础和先导。从社会秩序治理的规则系统来看,国家层面的良法与社会层面的良俗的共治则是区域善治实现的重要基础。

- 10 The elements of the rule of law can not only be compared with the eight basic elements of the rule of law by LL.Fuller,but also refer to the compression of Fuller’s eight basic elements in American scholar Barry M.Hager’s work Rule of Law:Guide of Decision Maker.In this book,Hager proposes the core component of the rule of law:The first is constitutionalism;second,the law restrains the government;the third is independent judicial department;fourth,the law must be applied fairly and consistently;fifth,the law is transparent and anyone can use the law.See Barry M.Hager,Rule of Law:Guide of Decision Maker(Mansfield Pacific Affairs Center trans.,China University of Political Science and Law Press,2005).Fuller’s eight elements,or Hager’s five components,are centered on the government’s management of society,and the focus is the legal constraints and regulation of managers like the government.There is a clear difference between this idea and the idea of joint participation in social governance of good governance.This mainly because that,in good governance,the rule of law is only one of the elements of good governance,rather than the only element.
