摘要(Abstract)：
发达国家、发展中国家、传统社区及部族之间关于遗传资源知识产权的利益博弈,已成为当下遗传资源领域的一次环境经济对话,成为各国、各利益主体在遗传资源领域的新制高点。遗传资源的知识产权权益保护战略及其制度配置即是对"历史财富生成及积淀功绩的追溯及重新界定",也是"向历史的一种还债"。基于所涉及时间轴的"历时性"、利益主体轴的"多方性",遗传资源知识产权需要一个体系化战略。从体系组成看,可由七个层面构成:夯实知识产权战略的环保内涵,深化价值目标;推进制定法与民间法互助,唤醒民间法治资源;引入集体主义方法论,走出个人主义危机;保护传统知识,拓展调整对象;创设遗传资源信息权新型权利;完善事先知情同意与来源地披露等保障程序;加强遗传资源知识产权制度运行的环境审查。
