The International Centre for Settlement of Investment Disputes( ICSID) under the auspices of the World Bank is best-known and most popular for resolving investorState disputes. As part of the system of the ICSID,the annulment procedures thereof have been increasingly employed by both investors and host States in recent years. Consequently, the international community expresses concern on the exercise by the annulment ad hoc committees of their powers as well as the increasing invocation by the losing party of the annulment procedures. These concerns include,for instance,whether the annulment ad hoc committees have observed the line between annulment and appeal. Another concern is whether there is an abusive use of the annulment procedures. This article is to examine,through analyzing the cases decided by various ad hoc committees,the relevant issues relating to the function of the annulment procedures of the ICSID,point out the problems and propose some recommendations for improving the mechanism.
